Terms of Use & Marketplace Agreement

The agreement governing use of the All Bus Sales commercial bus marketplace by buyers, sellers, and partners.

These Terms of Use ("Terms") are a binding agreement between you and All Bus Sales governing your access to and use of allbussales.com and any related services. By browsing the site, submitting a listing, sending an inquiry, or creating an account, you accept these Terms. If you do not agree, do not use the site.

1. Marketplace Platform Status (Advertising & Referral Venue)

All Bus Sales operates an online advertising, inventory display, and lead referral venue for commercial buses, motorcoaches, shuttle buses, school buses, salvage/dismantle units, and related parts. Our service consists of publishing listings supplied by third-party sellers and forwarding buyer inquiries to those sellers.

Unless a listing expressly identifies All Bus Sales (or an affiliated entity) as the seller of record, All Bus Sales is not a licensed motor vehicle dealership, broker of record, escrow agent, auctioneer, or title service. We do not take possession, custody, or title of third-party vehicles, do not store or transport them, and do not hold buyer funds.

All Bus Sales does not negotiate, draft, execute, or administer purchase agreements on behalf of any buyer or seller. Price, availability, terms of sale, deposits, payment method, delivery, and title transfer are agreed directly between the buyer and the seller.

Listing content — including photographs, specifications, VIN data, mileage, pricing, and condition statements — is supplied by the seller. We may format, reorder, or standardize listing text for readability and search visibility, but we do not independently verify it.

2. "AS-IS, WHERE-IS" & Warranty Disclaimer

All third-party commercial vehicles, salvage units, and parts advertised on this site are offered "AS-IS, WHERE-IS," with all faults and without recourse against All Bus Sales.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL BUS SALES DISCLAIMS ALL WARRANTIES OF ANY KIND WITH RESPECT TO ANY LISTED VEHICLE OR PART, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ROADWORTHINESS, DOT OR FMVSS COMPLIANCE, EMISSIONS COMPLIANCE, AND ACCURACY OF ODOMETER OR MAINTENANCE RECORDS.

Buyers are strongly encouraged to obtain an independent pre-purchase inspection (PPI) from a qualified heavy-vehicle technician, and to physically verify the vehicle, its VIN, and its title status, before transmitting any deposit, wire transfer, or other payment. Any estimate, calculator, payment illustration, range, or condition rating shown on this site is informational only and is not an offer, appraisal, certification, or guarantee.

3. Third-Party Services (Financing, Inspections & Shipping)

All Bus Sales may refer users to independent third parties, including commercial equipment financing providers (such as CFF), transport and drive-away operators, heavy-haul carriers, inspection companies, title services, and export logistics providers. These parties are independent contractors and are not agents, employees, partners, or joint venturers of All Bus Sales.

Credit decisions, rates, terms, down-payment requirements, documentation, insurance, licensing, scheduling, and pricing are established exclusively by the third-party provider. No approval, rate, term, delivery date, or inspection outcome is offered or guaranteed by All Bus Sales.

All Bus Sales accepts no liability for the acts or omissions of third-party providers, including loan denial or repricing, delay, in-transit damage or loss, mechanical failure after delivery, incomplete or inaccurate inspection findings, or failure to detect a defect.

All Bus Sales may receive a referral fee or commission from certain partners. Such compensation does not create an agency relationship and does not obligate any user to engage a referred provider.

4. Seller & Buyer Responsibilities

Seller obligations. By submitting a listing, the seller represents and warrants that: (a) it holds valid, marketable title to the vehicle, or express written authorization from the titleholder to offer it for sale; (b) the vehicle is free of undisclosed liens, security interests, or encumbrances; (c) all listing specifications — including VIN, year, make, model, mileage, engine, transmission, capacity, title brand, and condition — are truthful, current, and not misleading; (d) all photographs depict the actual vehicle offered; and (e) the sale complies with all applicable federal and state law, including odometer disclosure requirements.

Sellers must promptly update or remove a listing once a vehicle is sold, withdrawn, or materially changed. All Bus Sales may edit, suspend, or remove any listing, and may suspend any account, at its sole discretion and without notice, including for suspected misrepresentation or fraud.

Buyer obligations. Buyers are solely responsible for verifying, before purchase: VIN and title status (including salvage, rebuilt, flood, or lien brands), odometer accuracy, DOT and state compliance, insurance and registration eligibility, and the seller's identity and authority to sell. Buyers are responsible for executing the bill of sale, odometer statement, and title transfer directly with the seller.

Fraud prevention. Never send funds by wire, gift card, cryptocurrency, or peer-to-peer payment app to a party you have not independently verified. All Bus Sales does not collect deposits or purchase funds for third-party vehicles and will never ask you to route payment for a third-party vehicle through us.

Prohibited use. Users may not scrape, mirror, or resell site content; post false, duplicate, stolen, or infringing listings; harvest contact data for unsolicited marketing; circumvent security controls; or use the site for any unlawful purpose.

5. Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL BUS SALES, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF USE, DOWNTIME, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SITE, ANY LISTING, ANY TRANSACTION BETWEEN USERS, OR ANY THIRD-PARTY SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL AGGREGATE LIABILITY OF ALL BUS SALES TO ANY USER, FOR ALL CLAIMS COMBINED, SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY THAT USER TO ALL BUS SALES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WHERE NO FEES WERE PAID, NO MONETARY LIABILITY ARISES.

The site and all content are provided on an "as available" basis. We do not warrant that the site will be uninterrupted, error-free, or free of inaccuracies in third-party listing data.

Indemnification. You agree to defend, indemnify, and hold harmless All Bus Sales and its officers, members, employees, and affiliates from and against any claim, demand, loss, liability, damage, fine, or expense (including reasonable attorneys' fees) arising out of: your listings or content; your purchase, sale, transport, or use of any vehicle or part; your breach of these Terms or of any representation made here; or your violation of any law or third-party right.

Release. Because All Bus Sales is a venue and not a party to user transactions, you release All Bus Sales from all claims, demands, and damages of every kind arising out of or connected with any dispute between you and another user or a third-party provider.

6. Dispute Resolution: Mandatory Binding Arbitration, Class Action & Jury Trial Waiver

Governing law. This document and any dispute arising out of or relating to it, the site, any listing, any referral, or any communication between the parties are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

Mandatory binding arbitration. Except for claims seeking injunctive relief or the protection of intellectual property, and except for individual claims properly brought in small-claims court, any dispute, claim, or controversy between you and All Bus Sales shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, before a single arbitrator. The seat of arbitration is Orange County, Florida, USA. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this provision.

Class action waiver and jury trial waiver. ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY. YOU AND ALL BUS SALES EACH WAIVE ANY RIGHT TO BRING, JOIN, OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION, AND EACH IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING.

Supporting jurisdiction and venue. For any matter that is not subject to arbitration — including a petition to compel arbitration, a request for provisional or injunctive relief, or enforcement of an arbitral award — the exclusive forum is the state or federal courts located in Orange County, Florida, USA. Each party irrevocably consents to personal jurisdiction in, and waives any objection to venue in, those courts.

Time limit. Any claim must be filed within one (1) year after the claim arose, or it is permanently barred, to the maximum extent permitted by law.

Severability of this section. If the class action waiver is held unenforceable as to any claim, that claim (and only that claim) shall be severed from arbitration and heard in the Orange County, Florida courts identified above; the remainder of this section survives.

7. General Provisions

Changes. We may update these Terms at any time by posting a revised version with a new effective date. Continued use of the site after posting constitutes acceptance.

Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be limited to the minimum extent necessary.

Entire agreement. These Terms, together with the Privacy Policy, Seller Agreement, Listing Standards, and Financing Disclosure, constitute the entire agreement between you and All Bus Sales regarding the site.

No waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.
